I am have brother he is mental growth is low and IQ is poor he unable to earn we have made work for him xerox shop he goes there 9 am come back 12 pm again go at 3 pm come home 6 pm earn 60 to 100 rs. The first marriage was broke up and done second marriage but that also broke up and a HMOP was filled and his wife filed DVC case she order stay at home and my brother have pay 6000 rs we have file appeal. Now my brother not able to get box and tell statement. So how can I get divorce from court. All property was earn by my father only. is there any way to get out of this matter. plz help me a way from this

When you all were aware of the poor or unfit mental condition of your brother why you were getting him married and that two times, now you say he cannot stand in the witness box to record his statement in the court and you want to file for divorce on his behalf and for what?
You want him married once again third time and spoil the life of another young lady like this.
Unfortunately there is no provision for punishment for people like you who play with the life of others by cheating them by getting married to the person who is not fit for marriage because of unfit mental status and then come here is such forum for free of cost legal consultancy.

Apparently you have been unable to convince the court about income of male spouse and expenses of medical care………..
Otherwise court might have not ordered Rs.6000/ against income of say; Rs. 3000/.

If possible and acceptable try to convince the female souse and family to agree for MCD on amicable terms…
Get the brother treated from a medical specialist from a good institute..and let parents , brothers and family take care of him..
