That the marriage is solemnized 08/05/2004. from the year 2007 the wife resides with her parents house alongwith the son of 4 yrs. That on 18/02/2009 the husband and wife made an mutual divorce on Rs. 100/ stamp and the wife agreed in that stamp that she will give divorce as ealy as possible, But yet today she didn’t
What shall I have to do
I am ready to keep the son.

How could U agree to mutual divorce on a Rs. 100/ stamp?
The only way is to file a joint petition for mutual divorce u/s13B of the Hindu Marriage Act before the District court.

Now if she reuses to give divorce then you have no option but to file a suit for divorce under the Marriage Act. Only the decree of the court can dissolve the marriage between the couple.

wht ever is not permited is prohibited.
there is a specific clouse for divorce in law as avobe experts explain.
go through proper chennel,i.e.-
sec-13 hindu marriage act.any other help u can contect me .
