Do husbands have legal right over wives' earnings/savings

Querist : Anonymous (Querist) 27 August 2018 This query is : Resolved
Hello everyone,

I have another question from the team of experts here. Do Indian husbands have legal right over wives' earnings or personal savings? Can they claim anything from the wives savings if they already are working and have slightly less income then wives. Though please be informed that earning is only wives hard earned money and does not involve a single penny of husband.

Thank you !

No legislative law in India prescribes any control over wife’s earnings by her husband in whatsoever means.

Such things are being regulated by what is called “social laws” formulated by the society over the years.

Family is a private social unit. It should mostly be regulated by conventions and social norms rather than the legislative or case laws though there has been a constant demand for enacting more and more legislative laws.

Every aspect of human life is not driven by law. But your question is quite bad in the absence of any description of any problem and vindicates absence of personal bonding in a family life and non-establishment of mutual trust and belief between husband and wife in their marital life. Responsibilities of family have to be shared mutually by both the husband and wife. If you believe that only husband has to bear the responsibility of maintaining a family, you are absolutely wrong in understanding the meaning of a family in a married life. If there arises a question of "my" and "yours" in a marital life, a marriage becomes totally meaningless.

If that be, mutual consent divorce can be the best remedy for such type of a problem.
