hi,
hi want a solution of my query please help.
my grandmother(Mother's, mother) died 6months earlier, she was leaving in the house of MHADA she was the owner of that house, she was having 5 children's all were married and was staying separate except her 2nd child (my Mama) he is have property but gave it on rent. so after grandmother's death we decided to sell that house and contribute the amount among all of us. but the problem now is my Mama who was staying in that house is not ready to sell that house, but all are ready. and i have heard that he has done something and made that property on his name. so i want to know what document should i request in MHADA's office to know the owner of that house and if it is in his name what is the process to fight in court.

did your grand mother leave behind any nomination ? please cross check with he society . if your garand mother has left a nomination the society will trnasfer flat in name of your uncle if he is the nominee on his furnishing indemnity bond .
nominee is only a trsutee for all legal heirs .
find out on what basis mHADA society has tansferred flat in your uncle name .
since your garand mother died intestate apply for succession certificate

Unless your grandma transfer the title oin the property to your mama exclusively, he is not its full owner.
So check whether anything of that sort is done or not.
If not, then file suit for partition against your mama.

I agree with Mr Barman.If your grandma died intestate then you have to file suit for partition.

thanks you, all of you but can you please tell me which are the documents to be checked to know the legal owner of the property, in in case he has gave bribe and made that property on his name what are the legal procedure to figh

You are already advised/ Why are you dwelling on other aspect? It would be of no help to redress your actual grievance.

i went to the legal office they told me what u want to see, come 1 week later, so i want to know which document will tell me about the owner of the property so that i can ask them to show that document to know the owner
