Guest (Querist) 07 November 2011 This query is : Resolved
Husband has filed divorce. I gave complaint to police station on the tortures which i faced by him and inlaws. But since the civil case is pending in court, the police is not takine the complaint.

what to do?

You can move to court under 156(3) Cr.P.C. for an order for register and investigate the matter or may file private complaint in court.
Guest (Querist) 07 November 2011
arvind - ok. will do that. but it will take days to enquire n arrest them na

Police can not refuse action on this ground alone.

Depends what complaint you gave and whether it is cognizable or not.

why did you not file complaint under domestic violence act before the magistarte . ?
Guest (Expert) 07 November 2011
yes, Sethi Sb. is right, just file a complain u/s 12 DV Act (directly form the court).
Guest (Querist) 07 November 2011
ok wil do it.
wats the next step which will happen in DV case?

Depends on what kind of torture you faced.

What are the facts of the case. Be in touch with a good advocate in your area to guide you properly.

However, I would warn you against trumped up charges, as truth has an uncanny habit of resurfacing.

Pendancy of civil dispute is not a ground for rejecting a criminal complaint.

You can approach the SP of the district.
