Domestic violence act....

I filed a divorce case on my wife....have a proof of physical & mental cruelty.....and she filed a domestic violence , 498 a on me & family after that...my question as follows:-

1> If she get orders to stay in my father name home...what the next step immediately after that....what is restraining orders???
2> my divorce case is continue and can she still get order to stay in my home ?????

1. File appeal and prey for stay as the house belong to your father. Your father should also prey for the stay.

2. She can get orders.

Dear Querist
if the home is not matrimonial home and not a share household then the court may not pass the residence order, the court may pass an order for alternate accommodation.

your father may file a civil suit for injunction against her being the owner of the property as per judgement of Batra & batra he can get relief.

Restraining order means a temporary court order issued to prohibit an individual from carrying out a particular action, especially approaching or contacting a specified person.
