Doubt regarding obc creamy layer

(Querist) 10 August 2016 This query is : Resolved
My father works as a technician in a PSU (SAIL) which is equivalent to group C post. His annual income is more then 6 lakh per annum. So i will come in NCL category or not?
Ms.Usha Kapoor (Expert) 11 August 2016
Dear Client,

you belong to creamy layer and can't claim any reservations under OBC category. The Supreme Court of India In a number of cases put 50% should be the bench mark for SC, CT, and OBc etc reservations and if reservations exceed this limit they would be illegal and unconstitutional. Supreme court also introduced the concept of creamy layer. since your fathers annual income is 6 lakhs rupees you can/rt claim OBC status and claim the benefit of reservation.

malipeddi jaggarao (Expert) 11 August 2016
As per the existing rules, you cannot claim reservation under OBC as you do not meet the income criteria.
Raj Kumar Makkad (Expert) 11 August 2016
The national commission for backward classes has asked the Centre to raise the 'creamy layer' criterion for OBCs from the present annual salary of Rs 6 lakh to Rs 10.50 lakh.

If accepted, the recommendation to relax the salary bar for OBC reservations would bring more backward aspirants for central jobs and educational institutions in the reservation net.

'Creamy layer' is the income ceiling that separates poor OBCs from the well-off who are ineligible for quotas.

You can benefit from the advise of experts.
Rajendra K Goyal (Expert) 11 August 2016
You are not eligible as the income of your father exceeds the benchmark.
