Dear All,
I have a valid Canadian driving License. I also have an Indian learner's License. My car hit the road divider and suffered Own damages. There are no Third party injuries. should the Insurance Company allow Own Damage claims as per article 41.2 of Chapter IV of The Vienna Convention on Road Traffic,1968. Kindly advise,
Regards,
Vishwanath

Except the international driving license, no license issued by any other country for driving within that country can be valid in India. So, license valid in Canada cannot be valid in India.

Tne name of India is not appearing in the List of Contracting Parties to the Convention on Road Traffic 1968 so it is not valid in India.

Dear Agrawalji,
Though India is not a participant to the Vienna Convention, it continues to remain a party to the previous Geneva Convention on Road Traffic,1949.

Vishwanath ji,
Unless specifically provided in the relative act, neither the police, nor the insurance company can be expected to admit claim without the subject being a holder of international driving license. Any subsequent Geneva convention procedings has the overriding and supecession effect over the previous convention, unless the previous arrangements are adopted and included in the latest convention proceedings.
