Hi, There is a declaration needed to be signed for getting visa to one of the European countries. Below are the 2 points that i am confused on : 1.I have never been sentenced to pay an unconditional monetary fine for committing an offence 2.I am at this time not subject to prosecution for commiting an offence.
There is a DV case file against me and i am currently serving some interim maintainance. The question is , can I sign the declaration with the above mentioned declaration ? Please help .

Payment of interim maintenance do not constitue any punishment of payment of fine or commitment of any offence. You should write NO.

@Dr. J.C Vaishista... I was a bit skeptical at the start. I updated it now.Thnx for reminding. Also, Sir, I am confused about the answer for my second question: I am at this time not subject to prosecution for commiting an offence ? Am I under prosecution ? Can i sign assuming i am not under prosecution for an offence ?

Yes. you are under prosecution. DV is a criminal case before a Magistrate's court.
