Dear Experts,
Me wife had filled DVA on may 2011. We got married on 9.9.2007, we lived only for 3 months as a joint family[with my mother & father]. Then we lived separately till may 2011. But in DVA she inserted my father , mother, sister & brother and in-laws as they harassed her. We have 3 yr old son. She asked for maintenance and house for rent.I filled an RCR to rejoin. Now I am in my father's house & she is in her parents house. The issues which she said on me in DVA is not too cruel. Like drunkard , beaten & demanded dowry. we have the evidence of her father's speech that " all the complaints about the dowry said in case are false" this was the statement recorded by us.
1. Is that compulsory that my family members to examined.
2. According to maintenance I am ready.
3. Will the court ask me to arrange a rented house or in my parent house for her?
4. Is the evidence valuable.

can I get visiting rights? Can she file more allegations to make the DVA strong?

You have to understand one thing, mostly the dowry laws, d.v acts are misusing by such wives or with police influences.. So you have to face it before court of law. If you have merits mean you will succeed your case.

About your questions, as per procedure you and your family members liable to enquiry, if its fabricated complaint also you have to answer before enquiry.

About maintenance case you need not to worry untill its disposal. If its decreed favour to your wife mean then only you must pay maintenance to your wife. And also you filed a rcr petition, supreme court says in a land mark judgement, after restitution of conjugal rights petition decreed favour to the husband also, wantonly wife left him alone and staying separatly mean husband need not to pay maintenance to her. So proceed your case properly.

Surely you can ask visiting rights of your children.. You need not to arrange rented house to your wife, if mc granted mean you should pay. Rental expenses also will be included in mc amount.

The protection officer can grant exparte orders.
As per the DV act your wife can include your family members.
You can challenge the proceedings of the Protection officer before the High Court by writ.

Mr Shonee we have been separated from may 2011 only.. In my RCR i have asked for Visiting rights.
