Dear Sir
In the two months of married life my brother wife was registered Dvc case against my brother in the court of vemulawada of karimnagar district of telangana it was fake case
We are attending every trial in the court ,in the part of hearing judge conduct a counselling to the couple and instructed them apply divorce ,my brother wife was not attending the case since 3 hearing and now she was given a petition against my brother and parents in the local police station
Police ASI and CI was calling us through phone for counselling
Sir my query was it is possible to register a case in police station while DVC was running in the family court
Sir please guide me in this case

Even during the running of DVC case under 498A can be filed.
So engage a local alwyer and apply for bail first and then contest the case on merit.

Attend the police station. They will not proceed further if the complaint could be shown to be false.

I was heared that This 498 A meanance is over now. As per supreme Court order, police will not make any arrest without conducting an investigation. Section 498A of CPC has completely lost its teeth now

The menace of arresting without investigation under 498a case is over now on the basis of supreme court judgment, the section itself has not not been repealed, hence apply for AB and get enlarged on bail before attending investigation session with the police.

The police under the instruction, at least in Kerala, not to make arrest 498A cases without the specific sanction from the SP of the District.
