Ebay nutrition fraud(protein)

Hello sir my name is Charudatta Shinde
and i have purchased
"Optimum Nutrition 100% WHEY Gold Standard"
from ebay its basically an protein...but the thing is its a fake protein with just dust & coco powder its totally duplicate..and when i asked for refund from ebay they said me your request for protein is rejected under food & nutrition policy...so what can i do? anyone can sell under food & nutrition with fake things and fake seller can get rid of it and earn money? i like to case file against that seller or ebay too...what case i can do on seller and ebay?

Sue both of them by lodging a consumer complaint after notice of demand.

Before taking any legal action, better go through detailed terms & conditions of Ebay.

Whether the ingredients of the content shown on the pack are present in the product inside the pack, has these been properly got analyzed from lab.
If any misplay observed, go through the legal path.

You need to file a consumer complaint and send the item for the lab test so that the comapany, distributor and seller may be got punished as per provisions of law. Even CMO can be got involved including the Food & Supply Inspector.
