effect of switching over to a legal firm as a legal advisor

if a practicing lawyer wishes to switch over and joins a legal firm as a legal advisor or a law officer , does he need to surrender his bar council registration?or can he carry on both simultaneously?please guide me with your valuable advice.

If you become a full time and salaried employee of a company then you are bound to inform the same to the respective Bar Council as per rules under the Advocates Act.You can not be an advocate as well as a salaried full time employee of any private concern simultaneously.

It is advisable to carry on the designated post on retainership basis since then you can retain your advocacy.

Dear Prashant,

If you join a law firm as an advocate or legal associate, then there is no need to surrender your registration. But if you join a company as a law officer or legal advisor, then it is needed. The option available is to join a company as a retainer or legal consultant.
