I have a flat in a CHS in my wife's name. She is the sole owner. Only her name appears in the share certificate. Am I eligible to become an office bearer in the above-said CHS? As far as I know since I am not an Active Member nor an Associate member, I CANNOT become a member of Managing Committee. What is the legality of it and what will be the negative ramifications of it, if I am coerced into becoming one by the existing managing body ? For instance signing on various society related documents viz. Bank cheques, NOCs, etc...

Sir,
In order to become an Associate member of a CHS in Maharashtra, you have to submit an application as per "Appendix 5 [Under Bye-Law Nos. 19B & 19C]" and remit an amount of Rs.100/- towards associate membership fee.
You have to send the share certificate, to the society, for the inclusion of your name, without giving or transferring any title or interest in the ownership flat.
You have also to submit NOC of the member as per "Appendix 10A [Under Bye-Law No. 116(d)]".
After observing this procedure you can very well vote on behalf of the member, stand for election and become a member of the managing committee.
Good Luck,

Based on the given facts, not as a member, but you can be appointed as an advisor/ consultant of the society. That is as good as part of the management.

A non member cannot be a member of management committee especially for the purpose of authorised signatory in all those decisions making issues.
