Dear Professional Collegues
My office boy take away Rs . 150000 from the office but he not accept his offence.
Could any one tell what shall i do,what will be the legal procedings.
Specify Answer with particular section so i can file suit against him

File a case of criminal breach of trust u/s 406 of IPC.
If the money is not recovered then file a civil suit of recovery of money.

Dear Vishal,
Sometimes, a person considered to be a culprit out of certain misunderstandings or wrong reporting by some one else. But on facts coming to light, when some other person happens to be the real culprit, the wrong and injustice already done cannot be reversed.
Just think twice, if your office boy has attended your office after the incident and has not fled away, that could be possible only with the reason that he may not be having any knowledge about the missing amount of Rs.1,50,000/-.
So, at first, it would be better to investigate the matter properly before leveling the charge of embezzlement. You may, however, lodge a report with the police for investigation and to trace out the real culprit.
However, if you have some solid proof against him, like CCTV footage, etc., you can take legal recourse to get him punished for breach of trust and fraud.

St way go to Police Station and Lodge ur complaint and say you suspect Mr.X, your office Boy.

on the date of the incidents, you will have to recall the footfalls in your office and the possibliity of anyone misusing your keys of the locker where the cash was kept has to be reviewed to narrow down the culprit

Even a child knows that in case of embezzlement one has to rush to Police and police shall take action in accordance to law.
