Encroachment of my site by neighbour in bangalore

(Querist) 13 January 2012 This query is : Resolved
I need guidance on how to save my property in bangalore from a landgrabber neighbour. My site was encroached by a neighbour who claims to be a major in the Indian Army..he has built a shop etc on my part of the land about 400 sq ft of my land. I have documents to prove the land is mine, he has not shown any documents till now. He threatened my parents. We complained to the Police and got a stay order from the Civil court with the help of a lawyer. My aged parents are running from pillar to post as Im unable to run behind this as I work in Chennai. Police in that station say that we need to be tough and use force otherwise no one can help.. we dont have that kind of influence. Since we are not able to get the address of these encroachers(they live elsewhere), we are unable to deliver the stay order to them. What can we do? Any suggestions? how long will it take for the court to decide on this matter?

you have got interim reliefs . final hearing will depend upon pendency of court cases in court wherein you filed suit .

we do not advice you to use force to evict landgrabber .

you can paste the order on the shop premises .

if you dont have address of encroachers how did yu serve the summons? did you obtain order for substiuted service?

go by advice of your lawyer

Yes. You can paste a copy of the order on the shop premises if service of order is not possible.

It shall be good if the order is got published in news paper so that it may be got duly served as well as it may prove a notice to general public not to deal with such land or to face its consequences.

my advise also the same of ajay sir's..

simply dont keep the court order in your hand.. just consult your advocate, and act upon your advocate's advise..

File contempt petition in the court.
Option of Police help is there to implement the courts order.
