Encroachment on peripheral area of our building

Dear Sir,

One of our society member whose shop is road facing in which he has rented out it to a Doctor has encroached upon our society peripheral area which is encouraging other shops to follow the same.

I request to please advice on what action does our society committee can take.

Your guidelines will help us a lot.

Dear Sir,

Thanks for the advise.

Any further advise you would like to give us, as I have read one article which informed us, that after applying to MC the people of the department gets in contact with the offender and helps him to get the stay from the court and prolong the demolish-ion process.

If yours is a registered coop housing society, you can take up the matter in the general body and get a resolution passed to impose recurring penalty on the member concerned after issuing notice to him to remove the encroachment within a specified period. The penalty may be really high to force him to vacate the encroachment. The GB may also pass a general resolution penalizing such encroachments by any other member also. Pl see ur bye laws on the power of the GB to impose penalties on erring members.

However so therefore in such case is it advisable to also file complaint at municipal commissioner.
