Dear Experts, an enquiry officer in a domestic enquiry has conducted the enquiry and completed the proceedings. But he had not given the enquiry report. But now he says that due to his personal inconvenience and health problems, he is unable to give the report and has handed over the papers to the management? What should the management do now?

The management has to appoint a new enquiry officer. He has to go through the proceedings already recorded by the previous enquiry officer and continue the proceedings further.
No other option is open to the management.

I agree with Mr. Subramanan. In such a circumstance, the management has only option to appoint a new enquiry officer and sent to him the entire material arrived in enquiry before the earlier enquiry officer.Denovo enquiry is not permissible under the law on the same charges.
