If a person has qulified LL.B. and now working with some private company. when can she get the enrolment with Bar council. If somebody is a member of Bar coucil and later gets the job what she should do ? Whether she can be member of Bar council simultenously with her job with private company.

Enrollment is not permitted when one is in private employment. An enrolled Advocate has to surrender the Certificate of Enrollment to the concerned Bar Council and have the suspension of practice recorded by the Council. When she quits employment and resumes practice, she has to again apply to the Bar Council for resumption of practice.

Rule 51 framed under section 49(1) of the Advocates Act 1961 reads as under: An advocate shall not be a full time salaried employee of any person, Government, firm, corporation or concern so long as he continues to practice and shall on taking up such employment intimate the facts to the Bar Council on whose roll his name appears, and shall thereupon cease to practice as an advocate so long as he continues in such employment.
