Epf pension- wrong entries in date of borth

(Querist) 31 January 2016 This query is : Resolved
The date of birth of an employee was recorded as 19-12-1945 at the EPF office. But his actual date of birth is 19-12-1944. The mistake has been traced only now as the employee applied for weightage in pension. The EPF office refuse to correct its records stating there is no provision for making corrections after a lapse of 12 years. The EPF Appellate Tribunal also declined stating such cases are not taken up at the Tribunal. What is the remedy?
P. Venu (Expert) 01 February 2016
The DoB could be got corrected if the fault is not attributable to the employee but because of incorrect incorporation from service records.

lost in tribunal.

only hope is high court.
Isaac Gabriel (Querist) 02 February 2016
Dear Venu sir, The EPF authoritiesconcede the wrong entry But express inability to make corredtions due to the dely of 12 years and also point out there is no provision. Sudhir Sir, Thank you for your considered opinion.I shall be thankful for inputs by experts in the matter.
Sudhir Kumar, Advocate (Expert) 02 February 2016
further the query did not mention as to how the date was wrong and when it was pointed out.

date of birth change is normally sought nearing retirement and we have seen that a few years back an Army Chief failed in getting it corrected from Army HQ records and court declined to help him.

Anyway the decision of the tribunal is challengeable if within limitation.
