Eviction of son and daughter in law from my flat

1. I had been allotted a flat in a housing society as a member of that society. I have been living in that flat with my wife and my son and daughter in law since Mar 2005. My son and his wife has been having strained relations since beginning. He along with his wife had separated from me at least 4-5 times but had to join back with me at my flat due to financial constrains. He does not earn enough to support his family and his wife keeps taking up a job and leaves it in a few months.

2. I have handed over complete 'Stree Dhan' of my daughter in law to her and also obtained a written receipt for the same on a stamp paper duly attested by a Notary.

3. They are now living with me in my flat for the past 9-10 months. They keep fighting with each-other and create nuisance for me and my wife. My wife is a Parkinson's Patient for the past 20 years and needs care even for her day to day affairs. My son and daughter in law keep shouting at each-other and even started using abusive language now. It is creating tension in the house and having very adverse effect on my wife's health and four young children in the house (2 children of my son and 2 children of my daughter, who is divorced and living with me).

4. I want to evict my son and his family from my flat which I own and is my self acquired property.

I do think that you and your wife have every right to lead a peaceful life.
You have already brought up your son. Now after getting education if he can not maintain his family then it is his fault or misfortune.

Ask your son and his family to get out of your house at once.
If they stay your health and that of wife is going to suffer for sure.

you should immediatedly call upon your son and daughter in law to vacate the flat . if they refuse to do so move senior citizens Tribunal for necessary reliefs .

Dear Sirs,

1. I have tried to tell them to vacate my flat verbally but its not being done. Please advice how do I go about it? Do I need to give them a Legal Notice and than file a suit in Gurgaon courts ?

for senior citizens there is a senior citizens Tribunal . you dont have to go to civil courts . you should move senior citizen tribunal against your son and daughter in law . contact a local lawyer

No need for fling of suit as it takes time and money.
File an application in local Collector's office under Senior Citizen's Tribunal. Here no lawyer is required nor much time is needed.
