Eviction of tenant

(Querist) 16 July 2011 This query is : Resolved
If I go the court for eviction of tenant for bonafide use of property for my residential use. Can I sell the property after I get possession of the property.

Dear Sir,
If you file eviction petition under the ground of maintanance work to be done in the residential property, then the court will order that after finishing the work you have to handover the property to the tenant for further rent. But, at the same time if you file eviction petition with the reason that due to your financial possission you are willing to sell the property, then the court will allow you.

Eviction of tenant is not simple and easy, normally such matters go upto SC and do not expect any final order and possession thereafter in your lifetime.
prabhakar singh (Expert) 16 July 2011
you can even sell without his eviction, and your buyer can evict him more expeditiously.
Devajyoti Barman (Expert) 16 July 2011
Where does the property situate?
The grounds for tenancy in Bengal mostly allowed is reasonable requirement or default of rent.
Selling the tenanted property to satisfy the financial need is not a ground for eviction.
