Evidence(sms/mobile call list) to prove my ernest try to bring my wife back to join matrimonial life

Dear Experts,

Request your expert advice to help me out.

I have call details of year 2010 from my mobile number to my wife's Land Line and mobile number as well. I have invoices of such records.

In DV charge sheets my wife and her mother told in witness box that I have not contacted them after 2009 which is absolutely false after she quit matrimonial home voluntarily on her own.

I have few SMS's which I have stored in my mobile number which clearly denotes that I was keen to get her back with repetitive attempts but it is she who refused to join me and hence deserted me.

As I have my session court date on 27/01, kindly guide me with the legal contents of such affidavits which may showcase the same.

Also let me know which sections/act will help me to reproduce the same in the court of law.

The electronic document needs to be produced as evidence in court.Consult your lawyer.

Unless the official of the mobile service provider is summoned in court the Bills or the SMS es will not be taken into account.

You can do another thing. Ask for call details over e-mails. if they provide call details over e-mail, then you can produce print out of such mail as electronic evidence of this nature is admissible in evidence in court.

Full case file need to be referred, whether to what extent these proof would be useful to you. If not of much help may be avoided. If your lawyer is of the opinion that these are useful, get the operator summoned. May Submit the record with you along with your witness.

You may produce the evidences in your possession before the court, if it is objected by the opposite party, you may decide to rope in the service provider or any other means to establish the evidence held by you.
