Ex husband filing criminal case against the second Marriage

(Querist) 31 May 2010 This query is : Resolved
Hi Expert,

Please guide me as my Ex husband is filing criminal case against me inspite of having Legal Divorce and registered second social marriage.

He is doing all thesse for harrassement . Can I take any legal step against such harrasement.

For my first marriage it was just registered and never had any familly or social life.

If your second marriage is after the legal divorce, he can't sue you for bigamy. If he does so you may be discharged or acquitted by court, then you can sue him under Sec 182,193,IPC and also claim damages for malicious prosecution.

Thanks Experts for your Guidance. More in details.

I filled the divorce case against him on 2005 January. After repeated notice still the person did not appeared in the court. Then we published it in the news paper and got divorced in 2006 June.
The person lives nearby to my area. So now he saw that I am married as well as I have two year old son. My husband has put our marriage photographs in Orkut. So now he downloaded those photographs and accusing me about the marriage. But I am legally divorced and married now.
My lawyer is filing the case but still I wanted to know if any strong action I can take against the person .

Dear Mr.Arindam Pal,
At the first available opportunity when you have come to know that your ex husband is residing in your vicinity you should have furnished the copy of the court order which would not have given him opportunity of feigning ignorance and making false and frivolous accusations. By the way you can initiate defamation proceedings criminal proceeding so as to put the things in right perspective.
Best Regards
Daksh
