Hi,
My case is pending in court of maintance from 23 nov 2011 and divorce case is pending from 2012 in kanpur court.
My husband has got second marriage and has a baby boy. When I filed cases he wrie in his w/s that he has taken exparty divorce but he has not submitted divorce papers he attends date very rare and i got every date after 3-4 months.
How can I take early date while every dates are given by judge. I heard about expedite which is take from high court. in which high court ordered for early judgement. Please tell me in detail about it can I go for it for early judgement.

3-4 months for next date is too long even for busy courts like in Kolkata.
Take help of another advocate or at least consult with him.

Your lawyer should insist to provide short dates to the court and the second aspect which is being ignored is that you require to challenge the alleged ex-parte decree for divorce obtained by your husband.

Thanks Mr.Makkad for your valuable opinion I want to challenge him but he never comes on date and after every date court gives next date after 3-4 months. I can challanged him only when he appears on the dates.
I asked to my lawyer about early date so he Once he suggested that if I will get expedite from high court. Lower court can not give me delay dates. But when I said again for expedite he said its too early for your case as I filed my divorce case in may 2012 and maintance case in nov 2011.
