(Querist) 18 February 2018 This query is : Resolved
Hello,

My father has two separate properties he received from my grandfather through gift deed at Delhi 15 years ago.He wants to transfer these two separate properties on me and my brothers name respectively. Please let me know :
1) Approximate expense needed for the whole process
2) Documents needed for the same.
2) Is there a need to hire a lawyer for the same.

Your help in this regard will be highly appreciated.

Depends upon the value of each property, as per the market value or the circle rate fixed by the authorities, as the case may be. You may take help of some local lawyer or even some property dealer in the local market to help you.

5 percent of market value of the property. Market value will be in sub Registry office

If you have other Brothers and Sister than you and Brother then go for Deed but if you are two only hiers than property will come to you automatically to you by succession

Thank you both of you for your prompt reply. Yes we are 5 children in total, 2 brothers and 3 sisters. I believe that the sisters dont have any right for a share in it while the father is alive correct ? They cannot forcibly take their share from the father by filing a case, etc ? But if the father passes away then they will have the right for share this being a self acquired property ?

Your father may execute a "Will" bequething his properties to you and your brother after him or a Gift deed in favour you and your brother. if he will not executed a Will or Gift, after him, your mother, your sisters and brothers have eequal rights over that properties.
