Dear Experts, Thanks for your reply given previously but my doubt is in regards to admission of Writ Petition without serving notice to the respondent. The petitioner has only given the copy to the respondent whether Court/Registrar also gives notice prior to the admission of the Writ Petition, if the respondent has filed the caveat application in the court?

The CAVEAT does not apply to writ petitions. Caveat applies mainly to suits, appeals etc. In any case, when the copy of the writ petition has been served, it is for you to keep a watch on the cause list and put an appearance and make your submissions.

In some of the High courts,caveat is provided for writ petitions also. Even in Madras High Court,for a short period about ten years back,it was introduced but the same withdrawn within a short time. When notice of hearing has been served do not expect any further notice from the court., It will be superfluous. It is your duty to appear during the hearing and submit your objections. Otherwise the court is at liberty to pass orders hearing the petitioner.
