Dear experts,
I got married in april 2006 with out my parents willing means love marriage.From the marriage no tals with my parents, my brother, my sister and relatives also. In early 2007 my father sold the some part of agriculter land for 20 lacks. The property came to my father from my grand father. In 20 lacks amount ny brother taken 15 lacks and father taken 5 lacks for my elder sister they have given the dowry by selling the land before it . From this 20 lacks they given for intrest to a finance from there they are getting 2 ruppe intrest means 40 k getting every month as a intrest.This 3 years means after my marraiage they got nearly 15lacks from intrest also. I got all this news recently then immeadiatly I contacted my father through a relative my father replied you went away in your onway then why you are asking the share in the amount we will not give you and your brother is very much angry on you and moreover they are planning to sell the remaining land also.so, plz guide me how can I procced . iam eligible for only 20 lacks amount or iam eligible for intrest amount also. How I can stop the land selling. Plz guide me.

Engage an advocate file a suit for partition of family property check with advocate if amended hindu property act in which female members get equal rights is applicable to you. also ask competent advocate to file two interim applications one to maintain status quo and another for accounts of huf property income ; also include claim for mesne profits in the main suit .give full and detailed facts to your local advocate so that you get clear and correct advise .

vital raoji what is the meaning of this
if amended hindu property act in which female members get equal rights is applicable to you. the propertyactually bought by my grand father after my grand father expiry it came to my father

Dear Anonymous,
Inheritance means, becoming a owner of the property after the death of a person, as a legal heir of the deceased person.
Since you have said that the property was inherited by your father, from his father (i.e. your grand father), I assume that your father got the property after the death of his father.
Such inherited property is your father's personal property. It is not an 'ancestral property'.
A person can do anything with his personal property. No body (including you as his daughter) can ask for any share from the same.
If it is an ancestral property, then the grandson(s) and grand daughter(s) can rightfully seek a share. In such a case, you can ask for your share as per the amended Hindu Succession Act, 1956. If the property is not ancestral you cannot.

ramachandran sir . my father having 5 brothers my grand father died nearly 35 years back .10 years back all my father brothers taken the equal share including my father means 5 equal share

whether you married in another religion? if yes you cannot claim. otherwise you can file a suit for partition.
