you can file the case U/s 13 B of HIndu Marriage act and it will take minimum 6 months to get divorce and you can also claim the custody of the child and your husband will pay for the custody of the child

KINDLY NOTE THAT 1YOU MAY FILE A MUTUAL CONCENT DIVORCE PETITION.BUT KINLDY NOTE THAT ALL TERMS WILL BE FIRST AGREED BETWEEN BOTH HUSBAND AND WIFE AND A JOINT AGREEMENT/AFFIDAVIT CAN BE FILED IN COURT. 2.BUT IT WILL BE ADVISIBLE FOR YOU TO FILE A SEPERATE DIVORCE PETITION AND YOU CAN CLAIM MAINTAINENCE FOR YOU AND YOUR CHILD AND COURT WILL ALLOW YOU THE SAME AS PER LEGAL PROVISIONS OF SEC.24 OF HINDU MARRIAGE ACT.YOU CAN DEMAND AND DRAFT THE PETITION AS PER YOUR DESIRE AND THE OTHER SIDE WILL REPLY ,COURT WILL PASS DIVORCE JUDGEMENT AND DECREE.GOOD LUCK. With due respect to shri. Sawant, I am of opinion that proceeding u/s 13B would be faster. Issue of maintenance and custody of child can be solved by mutual agreement. Filing of separate proceeding and claim maintenance therein may spoil the relations and likely to create hurdles in divorce by mutual consent.
