Request to start the trial??

How to request the Court to start the trail or to request to send summons to the Complainant to start the proceedings in false 498A, Is there is Section in Cr P C for this request. Please suggest????

There is a procedure in criminal cases. If final report under section 173 Cr. PC hs been filed by concerned police then court has to take its cognizance and charge is framed and thereafter court has to call witnesses including the complainant to depose their evidence as per suitability of the Court itself. There is no procedure to get the proceeding concluded at the earliest as court itself has to see to dispose off case within stipulated period as directed by High Courts of respective area. Generally 5-6 opportunities are provided to the prosecution to coclude its evidence.

You can approach your high court by invoking its inherent powers under section 482 of cr.p.c for expedite trial.. Court will frame the time for dispose the matter..
