In-laws not handing over documents of late husband

Querist : Anonymous (Querist) 12 August 2011 This query is : Resolved
I became a widow about years ago. I have two daughters (1 adult and other minor). Though I had been living separately from my late husband for about 5 years, prior to his death we were not divorced. My two daughters were with me. On the death of my husband my in-laws got hold of his death certificate from the hospital and also the life insurance policies. For the last two years I have been trying amicably to get the documents from my in laws but to no avail. I have also sent legal notice for the same. Now I want to file a criminal complaint in Court to get them to give the documents to me.

Can someone please advice me as to which provision of the IPC will be applicable in my case? Also some judgements of similar case will be most appreciated.

Why you go in the web of criminal case instead of securing your civil rights?

You can also avail death certificate of your husband without help of your in-laws from concerned hospital. or municipality.

You should visit the office of LIC and should handover them a written representation to provide you all death benefits against the policies of your deceased husband. You should also file a civil suit seeking declation and possession over all properties left by your deceased husband. You and both your daughters can also claim maintenance allowance from your in-laws.
