i am police i working last 15 years so i suspended from Lokayukta , what about my service and promation. and my property
kindly suggest me

Dear Venkatesh,

Suspension is not a punishment under any Government's Discipline and Appeal Rules. You can also appeal with full justification to the prescribed appellate authority against suspension, if you feel that your suspension is unjustified, provided you know the reasons of suspension.

However, during suspension period, no promotion and increments are allowed.

After suspension, if there is a criminal case the police will file a case against you in a competent court of law, which you may have to fight with the help of some able lawyer. In addition, your department can also take necessary disciplinary action for the misconduct, if any, on your part.

But, if the charge is not of a criminal nature, the competent authority of your department will issue charge sheet against you clearly specifying the nature of offence, which you will be free to defend through a defence assistant to be nominated by you.

Till your case is decided, nothing is likely to happen to your property, unless specifically ordered to be siezed by Lokayukta or a competent court of law or the enforcement authorities. By that time you will also not be eligible for any promotion. All service matters, promotion, demotion, retirement, termination or dismissal, whatever that be, will depend only upon the final decision of the court judgment or the nature of penalty order to be issued by the competent authority of your department after the case is decided in favour or against you.

So, till then, you should be prepared to defend your case.

I agree with the observations of Shri. Dhingra. Most probably there will be a domestic enquiry. A show cause notice will be served on you by your Departmental Disciplinary authority. Take help of a lawyer while giving reply to it. You are at liberty to engage the services of a lawyer to defend you during the enquiery proceedings, with the permission of the Disciplinary authority or alternatively get the help of your union Representative to plead your case.

You are only under suspension. You have to prove your innocence during the domestic inquiry.

If you prove your innocence your suspension will be revoked, you will get back wages, and promotion if any as if you are in continuous service.

If you dont prove your innocence you will be terminated and has to face all the further actions.
