(Querist) 23 February 2012 This query is : Resolved 
Sir, my grandfather had a house in his name and money in his bank account.He had a wife , 3 sons and a daughter.He could not make his will and neither did he make any nominee in his accounts.Is it possible that now after his death the house and money goes to my grandmother without signing any document because one of my uncles is not ready to sign the papers.

Since there is no will, your grand mother and all her 4 childrens have equal right on the property. Every body have 1/5 share each. The entire property cannot be transfered in any one person's name without the express consent of others.

No!In the absence of Will it is now not possible that house and money goes to your grandmother without signing any document by other three sons and daughter heirs who all
have equal rights along with your grand mother and that is 1/5th each.

In the absence of a will - property automatically, without anything more, vests in the legal heirs to the share of 1/5th each - now since everyday wants to release their rights in favour of grandmother - they can do so to the extent of their shares - in the end with Grandmother can hold 4/5th of total property, with son holding 1/5th
