This query is : Resolved
dear sir,
my brother, who has encroached upon my property and running an illeggal guest house on it has advertised it on the net through a private ltd co in the same city who has prepared the website.
the cross ex of the def will start in a month. mine the plaintiff cr ex will end in nov 2012.
my query
1, is it obligatory for the pvt ltd co to depose in case summons are issued by the delhi high court where the case is in progress.
2. since he continues to run the guest house for over a year since he gave the affidavit in delhi high court that he shall not use it as a guest house, can i go for contempt of court for which i have evidences?
3. if so will the high court take into consideration the continued use of the property as a guest house and determine mesne profits on the basis that the property is still used as a guest house.
4. what is the likley outcome of the contempt app?
the defendant has violated the affidavits twice, once in 2009 and once 99n 2011 when he gave affidavits to the effect that he is not usinng the property as a guest house, both at the trial court and at high court.

Please go according to the advice of your own lawyer. If not hired any so far, better hire services of some capable lawyer at local level.

sirnoo
the query relates to contempt of court on which you remain silent.
why not submit any reply if you do not have to give an input.
your arguements are fallacious and i wonder how you have been appointed an expert where you do not provide any input.

Dear Vinay Kala,
By addressing "sirnoo" it is not understood, whom you addressed your supplementary post of Oct-12! However, even if you feel it otherwise, I would not hesitate to point out to you that as a free information seeker or learner you need to be sober in your language and also that only your arrogance is avoiding community people to reply your queries.
Being a retired DGM you need to know that even if you were in service, none of the members of this community happens to be your subordinate or paid servant to tolerate your directive or insulting language, as you have been using like the following:
(1) "why not submit any reply if you do not have to give an input."
(2) "your arguements are fallacious and i wonder how you have been appointed an expert where you do not provide any input."
Irrespective of whether Shri Ajay Sethi has taken note of your language, but frankly speaking, I have not relished your language.
I know only due to your insulting language and my reply, your earlier thread has been deleted by the administration, this thread is also likely to be deleted due to your arrogant and insulting behaviour.
I could well have replied your query, but through my earlier reply I could only suggest you to hire an advocate to solve your problem. But still, even on payment, he would not tolerate your language.
I hope you would not forget that you are seeking advice free of cost, which you cannot get as a matter of right or under compulsion to someone by use of directive or insulting language.
Now I can very well guess, why you are a sufferer from the hands of your own brother. Clearly your arrogance would have compelled him to take your challenge to get your property vacated, if you can.
