Birth and death

(Querist) 07 January 2013 This query is : Resolved
WHETHER THE APPLICATION CAN BE LODGED BY THE APPLICANT FOR HIS REGISTRATION IN JMFC UNDER BIRTH AND DEATH ACT?
IS THERE ANY PROVISION / CITATION ?
MohammedRaffiq Bijapur (Expert) 07 January 2013
If the registration is not done within one year then u/sec 13(3) of the Registration of births and deaths Act, petition is to be file in JMFC to obtain necessary order directing the authority to get enter the event of birth/death.
Raj Kumar Makkad (Expert) 07 January 2013
I don't agree. Judicial Magistrate first class has no role to play in the given matter. If registration has not been done then the complaint can be made to administrative officers but no criminal case can be filed against the erring person just on that ground.
R.K Nanda (Expert) 08 January 2013
no, u cannot file application in JMFC court.
