If Some One Downloads My Insurance details from LIC Site and by ITR filed by me from Income tax site without being authorised i.e. by hacking is he liable and can be booked under any section

Ethical hacking is punishable offence too in India.

Can i file suit on the person how have hacked and i wll have evidence in form of affidavit from tht person tht he has downloaded these information from the website as he is using this information against me in other case

You can definitely file a criminal case against such person.
