a police officer, against whom, myself is conducting deptt. enquiry,on the allegation that he has not conducted proper investigation. he has recorded some statements of witnesses u/s 161 cr.pc,and taken into possession the case property vide a farad, but he has not mentioned the same in the case diary of the case investigated by him, that he has recorded the statement and took the custody of case property.what will be implication of the case before trial court ? can trial court watch the case diary or the counsel of the accused? what is new authority in this regard ?
