Hi Experts,

My grand father is transfering a flat to my brothers but he want that it should be shared between all three grand sons.

please let me know procedure for this.

He should write a will.

He can write a WILL in which the right comes after the death or testator or he can gift the property on the name of all three grandsons.

Will is a better option bcoz the ownership wud remain with ur grandfather till his lifetime. Manytimes it happens that old ppl transfer their property to their children and if the children do not treat them well, they have no property of their own left in their hand.

Gift can not be reversed. Now it is your elder brother who can distribute the property.

Please let me know which documention or process need to be done by elder brother in order to divide property between brothers .
is family sattelment deed will be ok ,

Your elder brother can further gift a share in your name or can show it a sale to you.

The property is now duly owned and possessed by your elder brother and your grandfather has no role to play therein legally.

Now it depends upon your elder brother whether to transfer its 2/3 share in favour of you 2 brothers or not. If he is agree then better to execute and register a gift deed thereto.
