If NCR has been registered by the police then order can be passed to registered the FIR upon the application of 156 (3) cr.p.c in the same matter and facts disclosing cognizable offence

If non-cognizable report has been lodged by police then on the same offence on the direction of the court, FIR shall definitely be lodged though after investigation, the report accordingly can be filed before the court.

In present matter the NCR hasalready been registered if applicant moves application u/s 156 (3) cr.p.c upon the same facts diclosing cognizable offence the magistrate has power to register the FIR or not .reply with case law

IF what stated in the FIR makes out a cognizable case in the opinion of Magistrate only then he would order investigation else
