This query is : Resolved
In the court i had registered my marriage in 2010, reason behind her parents did not agree, but i m not married to that girl in reality. Still her parents do not agree to the above relation and I am not getting any clue since 3 years that she has got married or not. I am ready to get married because i am getting older day by day.
My Questions Are :-
1.) Should Do / Should Not Do.
2.) Suppose I plan Second Marrige, then her parents are ready or not ready to get involved in judicial proceedings, I really have no idea.
3.) Suppose I plan second marriage ( Bigamy )Please tell me the sentence or imprisonment.
4.) Advice me Do's and Dont's

Why invite proceedings & punishment for bigamy? Get the first marriage dissolved and start life once again on a safe mode.

All are donts only no dos.
Since you have registered your marriage, whether her parents agree or not you are in the wedlock with the girl. Unless you legally divorce her, you can not entertain the idea of marriage again. Send a notice to her asking to come and live with you. If no response, you file a divorce petition.

Avoid invitation of bigamy case. Send notice and file divorce case. Well advised by the experts.

I humbly Thank You all Personalities and Very happy to see you all sparing your precious time.
Next matter o discussion :-
1.) At the registration time v told lie in the court that v are married but actually v didnt marry to each other and our advocate produced registration papers consisting the material that v are married according to all customs and rituals in our parents presence. Then v separated due to no understanding and panchayat separated us. Then v compromised and decided to live together once again, hence v need to register this marriage so that in uture no one can separate us ( as adviced by our advocate ) and v said the same thing in the court and produced RECENT marriage photographs CLICKED IN GURUDARA including 2 persons as itnesses and got our marriage registered by telling lie to the court.
Questions Are :-
1.) Suppose I invite her to divorce and then the court comes to kno about lie at the registration time. Then....could v both be punished.....? on the basis that y did v tell lie to the court.
2.) Suppose she reuses to give divorce and m not ready to accept her decision and need divorce immidiately, then can I.....?

your wife is not staying with you . so you have to file for divorce on grounds that she has deserted you .you ought to have filed fr divorce long back if your wife was not staying with you for 3 years

File divorce preferably by mutual consent. The legal requirement of divorce can be explained through some common friend known to both. Knowing all the complications she may agree.
If not possible file divorce on the basis of cruelty and desertion.

Your misrepresentation to the Registrar that marriage was performed as per customs and rituals by producing fake evidence getting marriage registered is no way nullify the registered marriage. Even in the absence of rituals the Registrar would have performed marriage by exchanging garlands and then register the marriage. Registering marriage without rituals requires prior notice to public inviting objections. As a short cut if the marriage is performed and registration is sought after marriage within a specific period, evidence of rituals are required. Hence in any case mere registering the consent of both with witnesses in the office is legal marriage. If you say that you have misrepresented, instead of any help you are thinking to sought, you will land into problem for misrepresentation. Only course of action is to initiate for legal divorce by sending notice and filing divorce petition.
