Hi

there was a fir register under 420 120against 4-5 accused but only one has joined the investigation and got bail also frm high court now police has filled the charge sheet only against that person who has joined the investigation and there is no proof against that person in whole investigation and person has been declared po by the police yet to be declared from the court now should he file for quashing of fir what should be done

state detail facts, read your query, once you said that yhe police file charge sheet against that person who join the investigation & there is no proof against that person, then how police file charge sheet if there is no proof against him, police should filed FR against him, file a quashing petition if there is contradiction, it will be better to contact a lawyer personally with all documents

If such accused finds that nothing is against him in the charge-sheet, he should argue at the time of framing the charge and on failure should go to high court under section 482 for quashing of FIR against him.
