Divorce befor 1 yr of marriage

My brother is married in January'14. His wife left for her home in May'14 and she is not willing to return. My brother is also not willing to bring her back. We tried to convience both but no results. Can we go as per muslim laws and divorce as per mutual agreement. Also clarify wat happens if they file a case against us.

your brother does not need to go to court to divorce your wife . as per personal law in presence of witness can give triple talaq to his wife
