I have a small shop which was rented out to a tenant. He was running a general shop in the premises for the last 4 years. Now he has ran away and absconded. It is learnt that he got credit from many of the suppliers amounting to around 5 lakhs. My rent is also in arrears round 10 months? As the tenant himself is not available, how can I proceed to take the possession of the premises?

File a suit for possession after terminating the tenancy. Notice can be affixed on the premises. Summons of the court could be served through alternate method ( Publishing). Either the tenant appears and contest the suit or an ex-parte decree shall follow.

Whether he has vacated the shop or it is still under his lock.
If it is under lock, file suit for possession after terminating the tenancy.

You may file a suit for eviction and taking possession.
