obtaining chargesheet and certified documents

Dear sir, my jcb machine was burnt in a bombardment incident by some criminals before seven months. Soon after the incident the contractor of that site filed a fir in which the sl.no of my burnt machine was mentioned as it was engaged under him on rental basis. On my part i informed the finance and insurance company and filed claim. From that day around 8 months have passed and the insurance company is demanding the final report or chargesheet to settle the claim but i am unable to produce it as the police is not filing the chargesheet with the court. When approached the inspector doesnot provide correct information and misbehaves. When i approach the superitendent of police, he say that there is no reason of why the IIC is not filing the chargesheet and he would ask him to file it or a preliminary chargesheet to help me in my claim. When the SP calls the IIC, he says that he will file it soon but it never happens and two months have passed and now i have even stopped going to the SP as the IIC is not even responding to his request and he is even threatening to not file the chargesheet as i have complained in his name to the SP. Now i would like to know is how can i obtain the chargesheet and certified copy of the accused and witnessess list so as to settle my claim which is pending from 7 months and i would also like to know that if the police will not file chargesheet for even more than one year, will i have to wait to get my money or are there any other way out?

You can obtain the documents under RTI or from the jurisdictional Magistrate Court with the assistance of a lawyer.

You can get certified copy of charge sheet from magistrate court, consult some lawyer.

Thank you sir for your reply. But the problemis that he is not filing the chargesheet with the court. So how can i apply for it in court and he is even saying that i may take more than a year to complete investigation.

If the Insurance Company is not entertaining the claim, file consumer complaint.
