Society has passed a resolution owner of flat is allowed to park 1 two Wheeler and 1 four wheeler. L&L can park only 1 two wheeler. If a member has two flats and one he has given on rent can he park 2 four wheeler ?

Sir,
If there are two separate registered documents for the flats then he is entitled for two parking spaces, however parking permission for tenant will depend on the AGM resolution.

Depends on the society bye laws and AGM resolutions.

Parking rights will be devolved with flat registration document.
So whether owner or tenant or lease holder has the parking rights as per the registered documents of the flat.
The Society can pass the resolution only when there is any extra parking palace or visitors parking. The Society cannot restrict the parking rights already devolved with registration. It can only be done with the consent of the owner/s of the flat/s.
If the owner does not have any parking rights in the registered documents, then he has to oblige with the norms of the Society.

If the flat is given on rent than can the owner still park vehicle and have both previlage of owner and tenant rights.

1. Show the rent agreement to a local lawyer for analyses and opinion.
2. The society cannot have double standard for parking as stated by author i.e., some rule for member and other for non-member occupant, it must be challenged if any.
3. An anonymous author adopting a smart name i.e., windows 123????
