Hello,
My Name is Pramod Gaur, Male-48 yrs, an Ex Employee of PSU(Govt of India Undertaking). I am looking a senior advocate to take up a service matter case to "CAT New Delhi".
To brief little on my case:-
a) Under a notified SCHEME by my department wherein 5years Sabbatical Leave was permitted to regular employee. The SCHEME guaranteed and states that :-..........In case employee does not wish to rejoin, he/she will have to submit his/ her resignation and no notice period will be insisted upon. In case of those employees covered under CCS(Pension) Rules 1972 and are provided with voluntary retirement provisions therein, stipulated notice shall be served to the parent company. In such cases, terminal benefits will be settled as if the employee resigned/ retired the company on date of leaving on sabbatical........ā€¯
I excercised Voluntary Retirement under SCHEME while on Sabbatical Leave & served my department a Notice of VR on 16/01/2016.
b) After 5months relentless correspondences, my department issued incorrect VR orders wherein I was treated as retired from ENDING DATE OF SABBATICAL and also to settle terminal benefits from this date i.e. ENDING DATE OF SABBATICAL LEAVE. Even though SCHEME states that TERMINAL BENEFITS shall be settled as if employee retired the company as on date of leaving on sabbatical.
I want to contest to get the relief to quash incorrect voluntary retirement orders and to pass directions to Department to implement the SCHEME commitment in its letter & spirit. Such incorrect orders were issued by department on 2/7/2016. I have represented/ appealed to CMD of my department on 7/7/2016, reminder also issued after 30days. But, no reply till this date.

Instead of competent, your thrust is on senior,aren't you sure of your case. However, in Hon'ble CAT, Principal Bench, New Delhi, there are Advocates who practice Service matters in Hon'ble CAT, PB, ND only,there are Advocates who practice service matters in Hon'ble CAT, PB, ND, Hon'ble Delhi High Court, Hon'ble Supreme Court, also there are Advocates who are litigation lawyers, practicing in all types of cases including Service matters with equal ease. Here as you have desired, senior level, practicing in Hon'ble CAT, PB, ND, you can contact Ms. Jyoti Singh, Senior Advocate through her Associates, Mr. Ajesh Luthra, Mr. M.K. Bhardwaj, Mr. S.K. Gupta and the list goes on. It is advised, that you may see the daily cause list of Hon'ble CAT, PB, ND and you'll find the popular faces, private counsels having maximum number of their cases in the cause list. Dear Pramod,
Observation of Shri Pardeep Kumar is quite correct. You should have asked for the competent advocate in service laws, rather than senior advocate. Every senior advocate cannot be expected to be aware of service service laws and the Rules of the Government of India pertaining to the service laws. Frankly speaking, even out of the CAT lawyers, you can find not all advocates very competent and well versed in service laws.
I would rather, suggest you to go to visit CAT personally, spend full 2-3 days in observing presentation styles/pleadings of different lawyers there, try to judge their capabilities, effectiveness and perfectin in rules & regulations of the Government of India. Make a short list out of them, and then discuss the matter at length with them separately to find the most competent lawyer out of your short list.
In the meanwhile, if you like, you may send through email the scanned copies of the leave sanction memo, your notice for voluntary retirement, retirement orders, and subsequent correspondence with the PSU authorities for my general examination and opinion on the basis thereof to enable you to help proceed further.
