Property distrubution

My Father has SELF ACQUIRED property. There are no Ancestral Property.

We are Two Siblings. Me(Daughter) and My Brother.

My Father has decided to distribute the SELF ACQUIRED property between Me(daughter) and My Brother.

My Farther has proposed to give me "LESS" property to Me(daughter) and he has decided to give "MORE" property to by brother. Just to give an idea, he has decided to give 45% to ME and 55% to my brother.

When I expressed my displeasure, he is talking LEGAL. He says that, since it is SELF ACQUIRED, he has the right to decide what to give and how much to give. He says, if you want, you take or else leave, I shall give it to ORPHANAGE.

Since there is a "DISCRIMINATION" exhibited by my Father in distribution of his SELF ACQUIRED property, ARE THERE ANY LEGAL REMEDIES FOR ME.

Your academic query is not only academic, but quite hypothetical also that becomes quite clear from 45% + 65% = 110% out of 100% of property and also if your father talking about legal.

Your father does not have any need to talk legal, as he may or may not give you any part of the property that is at his sole discretion.

It is believed that A is Hindu.Confirm.


The position of your father is correct.

Take 45% by a valid and registered deed and thank your father.

65% was an error from my side. I should have rechecked before posting. Why both the learned people making that as a point of discussion in a public forum like this. Cant an human being make a mistake?

Secondly, there are no faltoo comments I have posted here. As a lay man, I am not fully aware of the law. Hence came here to take guidance. This is not hypothetical also.

I guess learned people can be bit more gracious when people like us come here seeking help.

Your father can sell / gift / mortgage / bequeath a will for his self acquired property during his life time in favor of any one he like.

You have no legal recourse against it.

Dear Ms. Mangala,

It is not the fault of Mr. Kumar Doab, if he was late in seeing your edited query, as he stated, "65% was not seen in your 1st post." also that he assumed on that basis only, "Hence nothing of 65% was posted for you."

Moreover, even after your statement, "65% was an error from my side. I should have rechecked before posting," if he still assumed, as against fact, that your query contained the figure of only 55%, even then he should not be treated at fault, as some persons prefer to rely on presumptions, rather than on facts, even on being admitted by the author.

About his remarks, "Ignore and avoid good for nothing Faltoo comments," the remarks were not aimed at you, but on me only. So, don't mind about that. I have also ignored his good for nothing faltoo comments.

By opening the thread, you can very well observe, what kind of enrichment he made.

After that he stated, "Expert Dr. J.C Vashista has appropriated with pointers to Apex Court."

Thereafter he stated, "indeed it is a good discussion."

Thereafter he stated, "Kindly continue to moderate and enrich the forum."

Still further, he stated, "Thanks for posting a query that lead to enriching discussion."

Lastly, he advised the author, “CONSULT YOUR OWN COUNSEL.” So even when the thread was duly enriched by Shri MV Gupta and Dr. J.C. Vashist, if he advises the author, “CONSULT YOUR OWN COUNSEL,” you can well understand, what kind of enriching he made from his side.

In view of the aforesaid instances, YOU CAN VERY WELL SEE THAT HE SEEMED TO HAVE FALSELY CLAIMED CREDIT FOR THE EFFORTS MADE BY OTHER EXPERTS. AS HE HAS NOT MADE ANY CONTRIBUTION FOR ENRICHING THAT THREAD.

Not only that, in the same thread, he even tried to unduly link the issue of "maintenance charges" by a lady with the "winding up of a company," as he stated, “Another thread that may be looked into is at:”

I have not authorized the other expert who made fun of you on this public forum, to advertise about me, or make fun of any querist/author or any query posted at LCI.



The said other expert has initiated in almost all threads and has been doing on his own.




Any querist/author can post a query and any expert can choose to reply or not to reply.



So much so that many of the querist/authors have been writing in the querty that the query may not be replied by Mr/Ms..........................




Obviously it was due to provocative/perturbing manner.
