Child custody

Sir

I am fighting a child custody case. It is expected that the judge will call my son and ask with whom he wants to stay . My son is at present staying with his mother. Naturally he will say that he wants to stay with his mother. He is 5 years 8 months old.

There is concept called “ Parental Alienation Syndrome”. Can anybody give me some good citations where the father has used this syndrome to his advantage to get the custody of the child

File for child custody under Hindu Minority read with Guardianship and wards ACt. The court mainly sees the concept of "Child;s Welfare is the paramount consideration".If the court in in its inquiry and overall circumstances feels that the child custody should be left to you and that is in the best interests of the child you will get custody.

At this tender age, the child requires the care and love of the mother unless there are compeeling grounds to show that mother is unfit. Have you pleaded any such reason?

The courts are intelligent enough to sift out truth form the tutored versions of child.
So nothing to worry. You will at least get visitation rights for sure.
If not then Calcutta High Court is always there ,if you are from WB, which is quite considerate on this type of cases as far as my experience is concerned.

Be satisfied with child visitation on expected order of the court, if you really have filed any case.

Otherwise, be satisfied with your lawyer's advice, if he has guided you on your point. But, you should not expect the experts to do home work of your paid lawyer to search and provide citations.
