My neighbour plot owner has opened a roshandan/window forcefully in my plot.

I have a plot on which my neighbour plot owner has opened a roshandan/window forcefully, even after requesting him to close it, he is so adamant not closing it. Actually he is a politically active person having lot of people in his back.

1) Kindly let us know how much land we have to leave in future due to this illegal activity, I have heard from somewhere that when you will do some construction you have to leave an area equivilaent to 3 ft*3Ft in front of the window becuase you can't stop the sunlight/air of anybody whole window is opened.

2) Please tell us how we can close the window as soon as possoible by taking the help of law and order (I read some where in the newspapaer there are 3.5 crore cases are pending in the indian courts)

If you step in to Court for this you will have to spend atleast a decade along with the expenses of Advocate.

If you are very Particular to close his window construct a wall in that place

Well advised by Mr Rajkumar. It will take a lot of time but still you should file a civil suit for injunction and compensation.

It is necessary else he will gain easement upon your land. By filing a civil suit, he will never gain easement and you will not need to leave even an inch of land.

You may construct higher wall, no need of leaving.

Otherwise file case for closing it etc. after discussion with your lawyer.

I feel town planning law are grosly violated in this case ,town planning rules and law are made so better human habitat is maintained , whole town is well organized , since he had violated town planning law his window opening on your land it seems. See town planning rules are not taught in llb , neither architecture students are left on self study . I would suggest visit office where building plan of your area get sanctioned. Check with then whether he has violated construction law. Be sure which law is violated and then for violation of that law you press that with planning authority ask under rti what action they have taken for that app. You may also construct case in court showing town planning violation etc.

I will suggest first get grip which town planning law he has violated be sure then next step
