When to exhibit docs in a summary procedure for eviction ?

Guest (Querist) 04 September 2010 This query is : Resolved
What is the process of exhibiting docs in the court in a summary procedure for eviction ? At what time the docs should be exhibited and whether they should be exhibited or not ?

Please tell that is there any need of filing any application to the court for exhibiting the docs or we can directly go to the court and take docs and show to them the docs which are on record,if we need to exhibit them to the court at all in our present case?

you have to exhibit them to make the court consider it as evidence on your side in the case.otherwise they will not be treated as evidence at all.

even if it is a summary procedure, the documents will be taken on record as a matter of evidence only if they have been duly exhibited at the time of recording of evidence. principles of evidence laws do apply to the summary rent proceedings also.

Documents relied upon by one party, if admitted by the other side, gets marked and considered as Exhibit as and when it is referred to in one's recorded evidence
